Please read these Terms of Service (together with our Privacy Policy and any applicable addenda, the “Terms of Service”) fully and carefully before using www.lizwilsonpilates.com and its associated platforms (the “Site”) and any services, features, content or applications offered by Liz Wilson Pilates (ABN 38 747 923 362) (“Liz Wilson Pilates”, “we”, “us” or “our”) (together with the Site, the “Services”). These Terms of Service set forth the legally binding terms and conditions for your use of the Services.

Acceptance of Terms

By registering for and/or using the Services in any manner, including but not limited to visiting or browsing the Site, you agree to these Terms of Service and all other policies and procedures published on the Site. These Terms apply to all users of the Services, including, without limitation, users who contribute content, information, or other materials.

Eligibility

You must be at least 16 years old to access or use the Services. If you are under 16, you may not use the Services. You represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. You are solely responsible for all activity associated with your account, including maintaining the confidentiality of your login details. If you believe your account has been compromised, you agree to notify us immediately.

A. “Content” includes all information, text, images, videos, scripts, graphics and materials made available on or through the Services.

B. You are responsible for any content you upload (“User Content”) and for ensuring that it is lawful and accurate. Liz Wilson Pilates is not liable for any loss or damage arising from access to User Content.

C. You must respect all intellectual property notices and laws when accessing or sharing content on the Services.

E. We do not guarantee that any content will remain available. We may remove or restrict content at any time at our discretion.

Rules of Conduct

You agree not to use the Services for any unlawful or prohibited purpose, or to:

Payments and Billing

A. Some Services are paid. Payment terms will be made available at the time of purchase.

B. We use a third-party payment processor. You agree to pay all applicable charges using your selected payment method and to keep your billing information up to date.

C. Subscription services will auto-renew unless cancelled in your account settings.

D. If your payment fails, you remain responsible for any outstanding fees.

E. Trial periods or promotional access must be cancelled before the end date to avoid being charged.

Refunds and Disputes

A. Refund Policy


We are committed to delivering high-quality educational services. If you are unsatisfied or experience an issue, please contact us at [email protected] within 14 days of your purchase. Refunds will be provided where required under the Australian Consumer Law.

Refunds are not available for change of mind or non-completion of a course. If you are unsure whether a course is right for you, we encourage you to reach out before purchasing.

B. Dispute Resolution


If you have a complaint or concern, we encourage you to contact us at [email protected] so we can attempt to resolve it informally.

If we cannot resolve the issue, you may escalate it to a third-party dispute resolution body such as Consumer Protection WA or the ACCC. All disputes will be governed by the laws of Western Australia.

Physical Activity Waiver and Assumption of Risk

You acknowledge that exercise is not without risk, and that participation in any program offered by Liz Wilson Pilates may result in injury. These risks include, but are not limited to: aggravation of a pre-existing condition, adverse effects of over-exertion such as muscle strain, abnormal blood pressure, fainting, disorders of heartbeat, and in rare cases, heart attack or other serious medical events.

By accessing this website, enrolling in our programs, or participating in any classes or movement content (including pre-recorded videos, written materials or live workshops), you acknowledge that your participation is voluntary and entirely at your own risk. You assume full responsibility for any and all risks associated with the use of our services and materials, including any injuries or adverse health events that may result.

You release Liz Wilson Pilates (ABN 38 747 923 362), its directors, instructors, employees, contractors, and representatives from any and all liability arising from your use or misuse of the Services, including but not limited to any direct, indirect, incidental, consequential or punitive damages, physical injury, illness, death, loss of income, loss of data, or business interruption, whether arising in contract, tort (including negligence), equity or otherwise, and whether or not Liz Wilson Pilates has been advised of the possibility of such damages.

As with any physical activity program, if at any point during your participation you feel faint, dizzy, experience pain, or have any physical discomfort, you should stop immediately and seek advice from a qualified medical professional. Always consult your doctor or allied health provider before beginning any new exercise program, particularly if you have any existing medical conditions, injuries, or concerns.

Photographic and Video Release

By attending live events, in-person workshops, or other activities hosted by Liz Wilson Pilates, you grant Liz Wilson Pilates and its affiliates the irrevocable and unrestricted right to use and publish photographs or video recordings in which you may appear. These may be used for marketing, training, promotional, or any other lawful purposes. You waive any right to inspect or approve the materials and any right to compensation for their use.

Hands-On Correction (if applicable)

Some in-person workshops or events may include optional hands-on correction or tactile cueing by instructors. You will always have the opportunity to opt out of hands-on interaction and are encouraged to communicate your preferences to your instructor before or during any session.

Warranty and Other Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted service, accuracy of content, or suitability for your specific needs.

We are not responsible for any loss or damage resulting from your use of the Services, including (but not limited to) viruses, outages, or errors.

Indemnification

You agree to indemnify and hold harmless Liz Wilson Pilates and its team members from any claims, losses, or liabilities arising from your use of the Services, your content, or your violation of these Terms.

Limitation of Liability

To the maximum extent permitted by law, Liz Wilson Pilates shall not be liable for any indirect, incidental, or consequential damages. Direct liability is limited to the amount you paid for Services in the 3 months prior to the claim or $500, whichever is greater.

Governing Law and Jurisdiction

These Terms are governed by the laws of Western Australia. Any disputes shall be resolved in the courts of Western Australia.

Modifications

We may update these Terms from time to time. Any changes will be posted on our website. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

Miscellaneous

A. These Terms constitute the entire agreement between you and Liz Wilson Pilates.
B. If any part of these Terms is unenforceable, the rest remains in effect.
C. We are not liable for events beyond our control, including system outages or internet disruptions.
D. You may not assign these Terms without our written consent.
E. All notices must be sent to [email protected] unless otherwise specified.
F. Our failure to enforce any part of these Terms is not a waiver of our rights.
G. Headings are for convenience only and do not affect interpretation.
